Definition
Definition of 'S. Demanuele' means S. Demanuele and its employees.
Definition of 'Buyer' means the account holder requesting order of goods or services and whose order is accepted by S.Demanuele.

Pricing
All prices are inclusive of 18% VAT.
S.Demanuele reserves the right to alter prices prior to dispatch of goods to reflect any direct or indirect increase in costs.
Any error or mistake in any item listed, quotation, invoice, price, or description shall be subject to correction without prior notification or liability on S.Demanuele.
Discounted items or any promotional discounts offered by S.Demanuele are subject until the end of promotion, or end of availability, whichever comes first.
All item prices and quantities shown on S.Demanuele website are strictly subject to availability.
S.Demanuele reserves the right to alter the cost of shipping or postage of goods after order confirmation.

VAT Exemptions for EU Buyers
For VAT exemption to business outside of Malta, but within the European Union (as allowed by European Union law),
- Send us an email with the products you are intersted in and your VAT number on info@sdemanuele.com
- Once the VAT number is verified, the Buyer will receive an invoice without added VAT and an email with bank details from S. Demanuele
- The order will be despatched once payment is cleared
VAT cannot be deducted on any orders that have already been paid for through Paypal

Returns
Goods not held in stock by S.Demanuele and subject to special order specifically for the Buyer are strictly non-returnable.
All electronic, consumables and sanitary items are non-returnable.
Goods opened from sealed packaging, or with damaged, or altered packaging are non-returnable.
Discounted items or any promotional discounts offered by S.Demanuele are non-returnable.
Returned items may be subject to a re-stocking fee at S.Demanuele discretion.
Should returns be accepted, only the cost of the goods returned will be refunded. Any postage costs incurred will not be refunded.
The Buyer is responsible for return, traceable shipping.
Manufacturer’s warranties do not compensate for any postage costs incurred when an item is required to be returned for investigation. The Buyer is responsible for the transit costs, and will not be refunded.

Payments
All orders shall be paid in full, and payment settled before dispatch of goods. Our Couriers are NOT authorised to collect payments.
When purchasing by credit or debit card via the website, all data is encrypted to the card processing company. S.Demanuele will have no access to, or save, any card details.

Deliveries
Orders take between 3 and 5 workdays to process.
The means used for order dispatch is at S. Demanuele’s discretion, unless otherwise agreed upon in writing.
S.Demanuele reserves the right to alter the cost of shipping or postage of goods after order confirmation.
The quoted delivery date should be considered an estimate. S.Demanuele will not be held liable for longer delivery dates.
For orders paid for through bank transfers, goods will be sent to the delivery address notified at the time of order.
For orders paid for through Paypal, the goods will be delivered to the address as registered on Paypal.
The Buyer is responsible for any arrangements necessary to take delivery of such goods. S.Demanuele will not be held liable for any additional charges required for such delivery.
All goods shipped or posted (both local or foreign) are not insured and at buyer's risk. It’s the Buyer’s responsibility to ask for insurance prior to dispatch.

Damages And Product Guarantees
Any damaged or missing items must be reported through the 'Contact Us' form within 2 days of delivery.
The product guarantee only covers damages or defects resulting from the manufacturing process. Any damages or defects resulting from misuse, wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow the instructions, lack of technical understanding, alteration, or repair on the part of the Buyer are not covered by the guarantee.

Right of withdrawal
You have the right to withdraw from your online purchase (contract) within fourteen (14) days without giving any reason. The withdrawal period will expire after fourteen (14) days from the day on which you, or a third party named by you, who is not the carrier, have/has taken physical possession of the goods.
To exercise your right of withdrawal, please send us an email on info@sdemanuele.com or electronically fill in and submit the Model Withdrawal Form via our Contacts Page (currently pending). You will receive an acknowledgement of receipt by e-mail without delay.
To meet the cancellation deadline, the notification of the exercise of the right of cancellation must be sent before the expiry of the cancellation period.
Consequences of Revocation
If you revoke this contract, we shall reimburse you all payments received from you, including delivery costs (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us, which also includes optional insurance on delivery), without undue delay and no later than within fourteen (14) days from the day on which we receive the goods back.
The refund will be processed using the same means used for the original transaction.
Goods must be returned to S. Demanuele, 3, St. John Street, Valletta, VLT1168, Malta, without undue delay and during the fourteen (14) days following the date of notification of the revocation of this contract.
The deadline is met if goods are sent before the expiry of the period of fourteen (14) days. Proof of postage must be provided.
The consumer shall bear the direct costs of returning the goods.
For local deliveries to Malta and Gozo, where goods have been delivered directly to local consumer/s’ homes or an address as supplied by the consumer/s via a third-party courier, which is not the local postal service, the consumer will have to bear the direct cost of returning the goods. If collection is to be booked by S.Demanuele, the same service as the delivery will be used. The courier cost will be verified prior to collection and will be deducted from the refund amount.
Returned items will be subject to a re-stocking fee which will be deducted from the final refund.
The amount refunded will be determined by the condition on which the returned goods are received. In cases where either the packaging or the product is/are damaged, sealed packaging is opened, or the product shows signs of use, S.Demanuele reserves the right to hold the consumer liable for the diminished value of the returned products and the product will not be refunded in full. This also includes damages sustained during postage and/or delivery.
In the case of functioning goods, including mechanical, quartz and electronic goods, S.Demanuele reserves the right to charge a fee for testing the condition of the returned goods.
Exclusion of the right of withdrawal
The right of withdrawal does not apply to distance contracts for the supply of goods that are prefabricated and/or customised to the personal needs of the consumer, or goods that are ordered specifically for the consumer.
The right of withdrawal does not apply to in-store transactions.

Data and Communication
All data or communication shared between the Buyer and S.Demanuele will be held confidential and will never be sold or shared with a third party.
S.Demanuele might use such data to inform the Buyer of marketing promotions or notifications.
All Terms and Conditions are automatically accepted by the Buyer upon request of quotation or order.
